These Terms of Use form a binding agreement between you CarCab, Express CarCab Inc. ("CarCab," "we," "us," or "our") governing your access to and use of the CarCab website, passenger app, driver app, communications, payment features, donation tools, and related services (collectively, the "Platform"). By creating an account, clicking to accept, or using the Platform, you agree to these Terms and the policies incorporated by reference.
1. How CarCab Works
CarCab helps people coordinate preplanned intercity trips and match available vehicle capacity with riders and eligible packages. CarCab provides the technology for users to find one another, communicate, reserve, pay, and document a trip. Unless required by law or expressly stated for a specific service, CarCab does not itself drive the vehicle, transport a rider, or carry a package.
Drivers post trips they already plan to make, including origin, destination, departure date and time, available seats, permitted luggage, package capacity, and price. Riders may search for a posted trip or publish a request. Senders may match an eligible package to a driver traveling toward the destination.
CarCab is designed for planned routes. Passenger and package matches should remain tied to a trip the driver already intended to make; the Platform is not intended to dispatch drivers for on-demand ride or delivery routes.
2. Eligibility and Accounts
- You must be at least 18 years old and legally be able to agree to these Terms to create an account.
- Minors may ride only when booked and supervised as required by CarCab policy and applicable law. Child seats and booster seats are the rider's responsibility unless CarCab expressly states otherwise.
- You must provide accurate information, maintain one authorized account, protect login credentials, and promptly report unauthorized access.
- CarCab may require identity, email, phone, license, vehicle, insurance, tax, payment, payout, or background-check information.
- CarCab may enforce one active session behavior. Signing in on another device or browser may disconnect a previous session.
3. Platform Role
CarCab operates a technology marketplace that helps independent users arrange preplanned transportation and package matches. Except where CarCab expressly states otherwise or law provides otherwise, CarCab is not the driver, motor carrier, employer, agent, insurer, owner, lessor, or operator of a user's vehicle. Drivers independently decide whether, when, and where to travel and whether to accept a permitted match. Nothing in these Terms overrides a legal classification imposed by applicable law.
4. Driver Promises
- You have all licenses, permissions, vehicle registrations, inspections, and insurance required.
- Your vehicle is safe, clean, roadworthy, and suitable for accepted riders, luggage, and packages.
- You will not exceed lawful occupancy or load limits and will follow the agreed itinerary, subject to safety and emergencies.
- You will not discriminate unlawfully, retaliate, solicit off-platform payment, or misuse user data.
- You are responsible for taxes, expenses, insurance, equipment, and legal obligations unless law states otherwise.
- A document accepted by CarCab does not mean your insurer has agreed to cover rides or delivery activity. You must confirm coverage with your own insurer.
5. Rider and Sender Promises
- You will provide accurate passenger, schedule, luggage, package, value, and contact information.
- You will review driver, vehicle, route, meeting point, price, luggage, and cancellation details.
- You will not request unlawful, unsafe, discriminatory, deceptive, or prohibited activity.
- You are authorized to book for any named rider, sender, or recipient and will share applicable rules.
- You will pay all displayed charges and reasonable authorized adjustments through CarCab.
6. Bookings and Communications
A booking is formed when the Platform confirms acceptance and payment authorization, subject to any additional confirmation shown in the product. Users should choose lawful, well-lit, reasonably safe pickup and drop-off locations. A driver is not required to make an unconfirmed detour. A material change to destination, timing, number of riders, luggage, or package details may require a new price or cancellation.
You consent to receive transactional emails, calls, push notifications, and text messages at the contact details you provide. Message and data rates may apply. Marketing messages, if any, are subject to separate consent and opt-out rights.
7. Web Access and Driver App Controls
Passenger web access may include profile updates, password support, verified phone or email updates, donations, ride search, delivery placement, reservations, payment methods, and history where enabled. Driver web access is limited to account care, profile, rating, read-only history, support, and dashboard information. Drivers may not accept, start, complete, cancel, or post rides or deliveries from the web unless CarCab explicitly enables that feature later.
8. Fees, Payments, Payouts, and Taxes
Drivers may select a price within any range or limit displayed by CarCab. Before checkout, CarCab displays the rider or sender total, including price and any applicable platform fee, taxes, optional services, or authorized adjustments. Drivers see the amount they may receive to offset travel expenses before confirming a match. CarCab's current launch platform fee is 10% of the trip transaction, but the exact amount shown at booking controls.
Driver amounts are intended to help offset reasonable travel expenses for a planned trip, including gas, wear, maintenance, parking, and tolls. They are not a promise of profit, wage, employment benefit, or guaranteed income.
Payments, cards, donations, refunds, and payouts may be processed by Stripe or another approved provider. Driver payout timing may be affected by verification, reserves, disputes, refunds, chargebacks, legal process, or risk review. Each user is responsible for taxes applicable to that user.
Drivers may not demand off-platform payment, add undisclosed fees, or condition safe completion of a trip on an additional payment. Riders and senders may not use chargebacks to avoid a valid payment.
9. Cancellations, Refunds, and No-Shows
Cancellations, refunds, credits, no-show handling, and driver compensation depend on the booking status, timing, evidence, payment state, cancellation rules displayed before booking, and applicable law. If a driver cancels, the rider or sender ordinarily receives a refund of the amount paid for the canceled booking, but CarCab does not guarantee replacement transportation or delivery.
If a trip is disrupted by breakdown, severe weather, road closure, illness, safety concern, or another event outside reasonable control, CarCab may issue a full, partial, or no refund based on the portion provided, available evidence, driver expense-offset amounts already released, and applicable law.
10. Safety and Community Standards
- Follow all traffic, seat-belt, child-restraint, parking, and vehicle laws.
- Never drive while impaired, dangerously fatigued, distracted, or medically unable to drive safely.
- Do not carry weapons, illegal drugs, hazardous materials, stolen property, or prohibited packages.
- Do not harass, threaten, discriminate against, stalk, exploit, or sexually misconduct toward anyone.
- Do not share another user's personal information, messages, images, or trip details without a lawful reason and permission.
- Do not impersonate another person, falsify documents, manipulate ratings, or create duplicate accounts to evade enforcement.
- Use emergency services first for an immediate threat. CarCab support is not an emergency service.
Where available, a women-only preference is intended to help users express a matching preference. It is not a guarantee of identity, safety, or availability. CarCab may verify eligibility, restrict misuse, and adjust the feature to comply with applicable law.
11. Package Delivery and Optional Protection
A sender must accurately describe the contents, dimensions, weight, value, handling needs, sender, recipient, and lawful purpose of every package. The launch package limit is 25 lb, approximately 10 kg, unless a lower limit appears in the product.
Illegal, stolen, counterfeit, hazardous, controlled, age-restricted, cash-like, irreplaceable, biological, live animal, temperature-sensitive, or otherwise restricted items may not be sent unless CarCab expressly approves a compliant program.
The sender is responsible for secure, lawful packaging that withstands ordinary handling and vehicle movement. Drivers may refuse leaking, damaged, unsafe, suspicious, misdescribed, or improperly packaged items. Recipients may be required to provide a code, signature, or identification.
Where permitted, CarCab may require delivery photos, time and approximate location records, pickup codes, handoff codes, recipient codes, signatures, or documentation of an unsuccessful attempt. Eligible package deliveries may be covered by up to $200 in package protection after support review. Optional package protection, if available, must be selected and paid before handoff and is subject to eligibility, declared value, evidence, exclusions, and claim limits.
12. Verification, Ratings, and Account Action
Verification, document review, ratings, and background checks reduce certain risks but cannot eliminate them. A badge or approval is not a guarantee of identity, behavior, qualifications, insurance coverage, or future safety. Users must exercise independent judgment.
CarCab may warn, restrict, suspend, or terminate an account; hold or reverse a transaction where permitted; preserve evidence; and report suspected unlawful conduct when reasonably necessary to protect users, comply with law, enforce policies, or investigate fraud.
13. Prohibited Conduct
You may not misuse the Platform, scrape data, reverse engineer protected components, introduce malware, evade fees, manipulate location or identity, create fraudulent transactions, infringe rights, harass users, interfere with operations, or use CarCab data to build a competing database except as law permits.
14. Content and Feedback
You retain ownership of content you submit. You grant CarCab a worldwide, nonexclusive, royalty-free license to host, reproduce, adapt, display, and share that content as reasonably necessary to operate, secure, improve, and promote the Platform, subject to the Privacy Policy. Feedback may be used without restriction or compensation.
15. Disclaimers
To the maximum extent permitted by law, the Platform is provided "as is" and "as available." CarCab disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. CarCab does not guarantee a match, user identity, arrival or delivery time, route, vehicle condition, conduct, insurance coverage, package condition, or uninterrupted Platform access.
16. Limitation of Liability
To the maximum extent permitted by law, CarCab and its affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or lost profits, data, goodwill, travel, or business opportunities. CarCab's aggregate liability arising from the Platform will not exceed the greater of the amount you paid to CarCab in the 12 months before the event or $100, except where law requires a different result. This limit does not limit an express package-protection benefit or liability that cannot lawfully be limited.
17. Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless CarCab and its affiliates from third-party claims arising from your unlawful conduct, breach of these Terms, vehicle operation, tax or employment obligations, package contents, or infringement of another person's rights.
18. Governing Law and Disputes
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles, except to the extent federal law applies. Subject to any non-waivable consumer right, the parties consent to jurisdiction in the state and federal courts serving Franklin County, Ohio.
19. Changes and Contact
CarCab may update these Terms. Material changes will be communicated through the Platform, email, or another reasonable method and will apply prospectively from the stated effective date.
